5. Your content

You retain ownership of all content, data, and materials you submit to the Services (“Your Content”). By submitting Your Content, you grant us a limited, non-exclusive, royalty-free licence to process it solely to provide the Services to you.

We do not use Your Content to train AI models. This commitment is contractually enforced against our AI model providers. See our Privacy Policy and AI Use & Transparency Policy for full details.

You are responsible for ensuring that Your Content does not violate any law or third-party rights. We may remove Content that violates these Terms or applicable law.

9. Warranties and disclaimers

We warrant that the Services will perform materially as described in our documentation. We will use commercially reasonable efforts to maintain availability.

EXCEPT AS EXPRESSLY STATED, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI Outputs are generated by AI models and may be inaccurate, incomplete, or inappropriate. You should not rely on AI Outputs for medical, legal, financial, or other professional advice without independent verification.

IN NO EVENT SHALL NEXTGEN INTELLIGENCE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless NextGen Intelligence and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
